We are looking for experienced Scottish criminal solicitors to undertake training which will allow them to train other solicitors in what’s involved in police station interviews.

The Criminal Justice (Scotland) Act 2016 consolidated the Cadder decision in respect of solicitors providing police station advice to suspects before and during a police interview. It also gave rights to vulnerable people and those under 16 not to consent to an interview without a solicitor. These changes have had significant impact on the role of the solicitor at the police station. 

In order to support the profession to meet these new demands, we are developing specialist training to enable Scottish solicitors to deliver appropriate and high quality legal assistance to their clients in the police station. This training will account for no less than 6 hours verifiable CPD.

We are now inviting applications from members of the profession to be trained to help us roll-out this training to all Scottish criminal lawyers.

Additional Information

You must be a member of the Law Society of Scotland with a current practising certificate and five years’ experience and practice in criminal law (including traineeship). Experience in teaching/tutoring is desirable but not essential. Training will include small group and interactive work.

You must give an undertaking that:

  1. You will be available for two or more full day sessions of training (within a year) to deliver the roll-out of the training to the profession. The training to be delivered is expected to be a one day course, but may be modified on request, subject to approval by our CPD & Training team to deliver bespoke training.
  2. You will not use or adapt the course materials provided, and as such they will be restricted to be used solely in conjunction with the Society’s delivery of the Police Station Interview Training for Scottish solicitors and you will not use or adapt them for your own purposes or for any other CPD or training organisation.
  3. Your employer will allow you time off to provide two days training during the year. 

We are keen to obtain applications from solicitors across Scotland, as the subsequent training will be made available regionally as well as centrally. We would also be interested in solicitors that have differing years of experience.

Participants will benefit from attending by enhancing and developing their knowledge, skills and abilities in this key aspect of criminal law and procedure. 

Our train the trainer sessions will be supported by Dr Yvonne Daly, Associate Professor of Law at Dublin City University. We anticipate using police officers and students to help act out the various interactive scenarios.

Participation in the train the trainer course will be free. No travel or accommodation expenses will be paid. The training will also count for CPD. The number of verifiable CPD hours will be confirmed.

Please email [email protected] confirming your interest in undertaking this train the trainer training, outlining briefly your background and experience along with any teaching experience. The application should be approximately 300 words. CVs are not required. Deadline for submission is 30 July 2018. This date for the training day (Saturday 27 October 2018) is provisional, so please let us know when you apply if this date is suitable for you.

  • You will be asked to complete an online questionnaire which will include your experience of suspect interviews (personal or anecdotal.) This information will be anonymised and will be used to form a pool of knowledge of issues that may arise at police station interviews. These submissions will be included in the face to face sessions.

  • To be completed ahead of the training day (up to four hours). Will include:

    • background knowledge of the relevant up-to-date law
    • the topics that will be covered in the face to face sessions
    • the methods of interactive teaching which will be used in the training

  • A one day, face to face session focusing on developing the topics and skills covered in the online learning and applying them to real-life scenarios.

    Participants will take part in role play scenarios which replicate the situations experienced at the police station. We will be seeking contributions from your own experience and feedback on the course materials and scenarios.

  • Feedback after the course will include completion of a questionnaire at the end of the course. This feedback will help refine the course that is ultimately delivered to the profession.
