The Act of Sederunt (Simple Procedure) 2016 moved away from typical procedural legislation format in terms of the language used and grouping of the rules. The departure is not limited to format and significantly broadens the managing and decision-making powers of the sheriff.

With the launch of a fully digital service for simple procedure cases on civil online, it is now possible for a civil case to proceed from end-to-end online. It allows submitting simple procedure cases, paying court fees, submitting supporting documents, responding to any claim lodged and tracking the progress of cases in court, all online, any time.

This seminar will provide an update of the key principles, rules and changes for practitioners. You will learn to navigate this fully digital service and assess what it means for your practice and clients.

    Having built up a solid reputation in the debt recovery and insolvency fields, Tracey formed TCH Law in 2009, specialising in debt recovery, insolvency, business dispute resolution and landlord enforcement.
    Tracey is a knowledgeable solicitor with a wealth of experience helping clients recover their debts and resolve their conflicts by providing a top class legal services to her clients, combined with a personal touch.
    Being a proactive and commercially-minded litigator means Tracey takes a pragmatic approach to litigation.  She is also a very approachable person and always strives to get the very best results for her clients. Tracey all the while considers not only the legal, but also the commercial, implications of the procedures available to her clients.
    She has built a team around her who also thrive on providing efficient and cost-effective debt recovery solutions.
    Since April 2012 Tracey has also been a commentator on insolvency and other legal issues on both television and radio, as well as speaking at and chairing a number of legal and business conferences.
    Additionally, Tracey's achievements were recognised when she was awarded 'Sole Practitioner of the Year' at the Law Awards of Scotland and TCH Law were awarded the honour of being Scotland’s inaugural “Debt Recovery Firm of the Year”.

    Scott is a solicitor in the firm’s busy Litigation department, handling a wide variety of civil dispute resolution matters on behalf of private individuals and a range of business entities at all levels of civil procedure.

    Scott undertakes work on behalf of both Pursuers and Defenders ranging from commercial, contractual and property disputes to contentious private client work, debt recovery and insolvency cases. A substantive part of my work involves regularly appearing in Sheriff Courts throughout the country, the Sheriff Appeal Court and the All Scotland Sheriff Personal Injury Court, whether as principal agent or as instructed by other Solicitors around the country on behalf of both Pursuers and Defenders.

    Scott is also a registered Notary Public and a member of State School Lawyers, a social mobility initiative which highlights the enormous contribution to the legal profession of individuals educated in the state sector.
