No matter how many safeguards we apply, or how carefully we plan, accidents happen in the workplace. According to the Health and Safety Executive, 144 workers were killed in 2017/18, while an additional 100 members of the public were killed in workplace activities. This is tragic and can be a time of great difficulty for in-house counsel at affected organisations, putting them in an awkward position regarding relationships with regulators and co-workers and in understanding the role of legal professional privilege in conducting their investigation.

This seminar will provide delegates with valuable advice on how to conduct an accident investigation or fatal accident inquiry, manage relationships with regulators and consider when a privileged report might be required.

    Speaker

    Charles Livingstone is a partner in the Government, Regulation and Competition division at Brodies LLP. He advises and acts for clients in relation to the full range of competition law issues, including antitrust compliance, enforcement and investigations of potential or actual breaches of competition law. He also advises and writes on issues relating to legal professional privilege, including recent caselaw on the limits of privilege in the context of investigations.
