A year and a half after the new Simple Procedure Rules came into place, examine the lessons learned so far with debt recovery experts David Alexander and Scott Runciman.
In November 2016, simple procedure replaced the small claims and summary cause procedures in the Sheriff Court for actions seeking payment of sums up to £5,000.
Two years on from implementation, a number of issues continue to be raised with the new system and the Scottish Civil Justice Council is reviewing how the rules work.

David Alexander, Head of Debt Recovery, Gilson Gray
David has specialised in litigation and debt recovery his whole career. He appeared in court on a daily basis for almost 16 years. He has run countless proofs and debates. His expertise is such that firms both in and outwith his home city, Edinburgh, instruct David to appear for them and conduct their cases, or appoint him to act as Commissioner with regards to the recovery of evidence or the recording of evidence from witnesses.
David’s department at Gilson Gray has grown considerably since the firm opened its doors four years ago. The department now deals with a high volume of instructions each week, the majority of which are Simple Procedure cases. The department are experienced in raising these applications and dealing with the varied and time consuming queries raised by the Sheriff Clerks throughout Scotland. David and his team were chosen by the Scottish Court Administration to trial the new Civil Online, the secure online case tracking system before it went public.
Scott Runciman, Solicitor, Gilson Gray
Scott Runciman is a newly qualified solicitor within the Debt Recovery department at Gilson Gray. He has been working with Simple Procedure since it replaced the Small Claims and Summary Cause rules in November 2016. Scott regularly deals with Simple Procedure claims on behalf of claimants and makes frequent appearances at Edinburgh Sheriff Court. Earlier this year Scott took part in testing Civil Online, the Scottish Courts & Tribunals Service’s web based case tracking system, providing input on the back of his experiences with Simple Procedure. Scott previously worked for a firm of Messenger at Arms and Sheriff Officers gaining experience in Scottish diligence.
